Understanding Florida’s Auto Insurance Laws

As a no-fault state, Florida requires drivers to purchase $10,000 in personal injury insurance and $10,000 in property liability damage. Personal injury protection (PIP) will cover 80 percent of your medical expenses and 60 percent in lost wages.

Florida follows a pure comparative negligence rule, which can reduce your compensation amount by the percentage of your fault in the accident. For example, if you were 30 percent negligent, your recovery would be reduced by 30 percent. In other words, you would be entitled to a 70 percent monetary reward. However, if you were 50 percent or more at fault, you can’t recover total compensation.
